On January 11, the US Senate introduced the Music Rights Owners Equity and Rights Protection Platform Act. This is the second iteration of the bill, which was first introduced in April 2006, and it’s obviously a big score for the recording industry. The act essentially requires music service providers, including satellite radio and cable providers, to use all available means to prevent music piracy. For users, this means not burning songs to CD.

The most important thing is the relationship between the music industry and the consumer. Any facade of goodwill is quickly crumbling. Despite the undeniable backlash from consumers, music professionals are no closer to offering a viable solution. Record labels are reluctant to interpret this as a war on consumers. But consumers have waged war on record companies by streaming digital music freely and unhindered via e-mail, cell phones, and portable music players.

It’s worth noting that independent record labels and artists themselves freely distribute songs to consumers without DRM. But the big record companies argue that giving away music isn’t much of a business plan. The global association of independent record labels has announced a collective agreement with download sites through agency Merlin. The move will give India a foothold in the market for payment-based digital music sales. Because at the heart of the argument is a very simple concept; listeners have to pay for the music they listen to.

This week at MIDEM, the music industry trade show, the music industry will continue to debate its position on digital music distribution endlessly. Fair or not, music industry executives have to find a solution to the problem. Consumers have drawn a line in the sand, and record labels would be wise to find ways to make that happen. They need a system that works for them and is convenient for customers.

The alternative is to move to a completely free and fluid music sharing system. We are already one step closer to achieving such results. A generation of listeners grew up in the era of free digital music sharing. Who can convince them to pay back the privilege? It is not too far-fetched to say that it is too late to compromise.
